Terms & Conditions for Hot Yoga Health
Please ensure you read and understand the following updated Terms and Conditions. Thank you.
TERMS & CONDITIONS DEFINITIONS
HYH means YogaGem Limited, and is the owner of Hot Yoga Health.
The yoga area is the entire area beyond the glazed doors in the hall, and includes the yoga studio, seating and shoe storage areas and the changing rooms.
A member means anyone who has completed the HYH online registration and paid for a class or classes up to the point where they have used up the time they have paid for and departed from their final class.
The Terms and Conditions are incorporated into the HYH registration online.
MEMBERSHIP
When a person has completed an online registration, and purchased a membership they shall become a member of HYH, subject to these terms & conditions.
Acceptance of a person as a member is at the absolute discretion of HYH.
A person shall cease to be a member when their membership expires or when the membership is terminated under the Terms & Conditions.
HYH reserves the right to expel from the studios, suspend for a specific period, terminate the membership of or refuse to renew the membership of any member whose conduct is, or maybe in HYH’s reasonable opinion, damaging to the character of the studios or amounts to a breach of these Terms & Conditions, or where such expulsion is otherwise in the interests of other members. Any member so expelled or that has their Membership terminated or suspended shall forfeit all privileges to membership of the studios and shall not be entitled to any refund.
A member may attend classes according to their type of membership.
Any membership must only be used by the person who purchased it, or by the person it was purchased for, and breach of this condition will lead to termination of the membership.
LIMITATIONS OF LIABILITY
In consideration of HYH accepting a person as a member, the member agrees that:
Neither HYH, nor any of its employees or agents shall be liable for any loss, damage or theft of any property belonging to, or brought into or left outside any HYH premises by the member or any guest of the member.
Vehicles left outside the Studio in our car park and bicycle bay are parked entirely at the owners risk, and HYH will accept no liability for loss, damage, or theft in respect thereof. Notwithstanding the above, the car park and exterior of the building is covered by CCTV, and historical information can be accessed for up to 30 days. HYH will make this information available to members or their agents (Police), at their discretion.
It is the members responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme which they follow, or class which they attend. Members accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any session. Members must provide full details to HYH before taking part in classes of any injury, sickness or other problem which may affect them.
ONLINE RESERVATIONS
Class size is limited and HYH accepts online reservations through the website www.hotyogahealth.uk and www.Mindbody.io and the Mindbody mobile app. All in studio classes are pre book only and HYH do not accept drop ins at this time. HYH does not take reservations by phone or email.
If you have reserved a space, you need to be present, ready and changed for class at least 5 minutes before the start of class to claim your booked place.
Waitlists: For classes that are fully booked up, you can place yourself on our online ‘waitlist’ beginning 14 days before the class. Once you are on the ‘waitlist’, as available spots come up in the class, then you will be moved from the ‘waitlist’ to a confirmed spot in class and will automatically be sent a text notification of this.
Cancellations: Cancellation of a reservation must be made online at least three hours before the scheduled start of class. HYH cannot take cancellations by email or phone (with the exception of sound baths, see below). If you fail to cancel and do not attend then your payment cannot be returned. We trust members not to abuse the booking system but if any member regularly books online and fails to show up for class without cancelling we will eventually have to block them from booking online.
Sound Bath Bookings and Cancellations: All payments for sound bath sessions are final and non-refundable. Due to the limited availability of spaces, cancellations result in the loss of your booking and payment. If you need to reschedule your sound bath session, please contact us at hello@hotyogahealth.uk at least 48 hours prior to your scheduled session. In such cases, we will transfer your payment to a future sound bath, workshop, or issue it as account credit. Cancellations made less than 48 hours before the scheduled session will not be eligible for a refund or transfer.
ARRIVAL POLICY
Because late arrivals disturb the class, we ask you to arrive at least 10 minutes before the start of class so as to be in the class, relaxed and ready to start in good time. The entrance door is locked before class, all classes will start promptly and no admissions will be accepted after the start time.
FIRST-TIME VISITORS
It’s important that first time visitors arrive at least 15 minutes before the start of their class - giving time to discuss details with the teacher and to be shown the way around the studio. New members must discuss any health or injury issues with a HYH teacher before starting their first class.
FITNESS AND HEALTH
Members must be prepared to discuss injuries or any other relevant information regarding their health with the HYH teachers. Members must always notify HYH of any circumstances in which new or developing health issues might be adversely affected by continued exercise in the studio.
Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have any concerns over their physical condition. HYH reserves the right to refuse access to any member, if in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such activities. It should be understood that HYH staff may not be medically trained and may not therefore be qualified to assess whether the member can engage in any exercise without detriment to the members health, safety, comfort or physical condition.
Many HYH classes involve intense exercise in a heated room. It is up to each member to assess their own health suitability for such classes and to seek appropriate further information from a HYH staff member if they are in any doubt. Members with abnormal blood pressure and/or cardiac irregularities should not attend class unless they have current written permission from their doctor. They are expected to use reasonable judgement and if they are in any doubt, the Member should consult their doctor.
If you are pregnant, talk to the teacher about alternative postures and avoid the hotter sessions during your first trimester. Members who are not well should have regard for others. They should not use HYH’s facilities if they are suffering from infectious, or contagious illness, disease or suffering from any ailment where there is a risk, however small, that such ailment may be detrimental to the wellbeing of other members. If in any doubt the member should consult their doctor, and must notify HYH of any advice given by their doctor.
USE OF THE FACILITIES
There is no smoking throughout the building and that includes e-cigarettes and other vaping devices.
No animals are allowed in the building except for guide dogs.
We have done our best to provide pleasing, immaculately clean, high quality facilities. Please treat them with respect.
Children under the age of 16 may only use the studio and attend classes if accompanied by a parent or an adult with the parent’s permission and attendance to class is approved by HYH.
HYH reserves the right at any time to withdraw all or part of its facilities or classes for any period or periods, in connection with cleaning, repair, alteration or maintenance work or for reasons beyond HYH’s control. HYH will, of course endeavour to minimise any such disruption.
All property left at the studio will be kept at reception to be claimed. It will be disposed of after 4 weeks, with the exception of towels which will be disposed of on a weekly basis.
VIRTUAL CLASSES
During the Covid-19 closures, HYH began offering classes streamed live over the internet. Your wellbeing is very important to us, and when participating in any of our live streamed classes, you understand that you will be performing exercises without the physical presence of a teacher in the room to fully observe you. In addition to following and accepting guidelines for in-studio classes, you accordingly agree to observe the following:
To avoid pushing beyond your existing limits. When you’re practicing yoga or any other exercises outside the hot room, you may find that it takes longer to warm up and that you could be more prone to injury if you attempt to push too hard.
To ensure you have a completely cleared, safe space to practice around you that has no trip hazards or items of furniture. To remove all jewelry when exercising. To avoid practicing if you’re unwell, or pregnant either now or within the past 6 months. To ensure you have booked into our classes through MINDBODY or the timetable page on this website. To have a capable person present in your premises to assist you in case of an adverse event/injury. To avoid attending online sessions if you’re in any way unsure as to your ability to practice safely.
It is your responsibility to make the teacher aware at the beginning of the class or via email at least one hour before the class if you have any injuries or health issues that may be affected by certain exercises. We cannot take any responsibility for any injury that you may sustain as a result of participating in a virtual class except where such injury has occurred through our proven negligence.
IN-STUDIO AND COVID-19 REGULATIONS AND MEASURES
All members must read and understand the new regulations and social distancing measures relating to Covid-19 safety procedures that HYH have put in place, these can be found on the website.
All new procedures and measures must be followed to prevent the spread of Covid-19 and ensure the health of all members and staff. Safety of everyone at HYH is our main priority and anyone seen to not follow the guidelines will be asked to forfeit their membership. Members joining in-studio classes will do so at their own risk, HYH will not be liable for any contracted viruses, should they occur. Members will agree to be contacted via email or telephone, regarding Covid-19 and part of the UK governments track and trace guidelines.
Should new measures be enforced and the studio needs to shut down all memberships will automatically be switched to Virtual Membership unless instructed otherwise by emailing hello@hotyogahealth.uk
RECORDING IN STUDIO
Some in-studio classes will now be recorded as part of our virtual classes that are available to members.
